According to Indiana Code, jail time and fines for drug related felonies are as follows:

  • Class D Felony: up to three years in prison and a fine of up to $10,000.
  • Class C Felony: up to eight years in prison and a fine of up to $10,000.
  • Class B Felony: up to 20 years in prison and a fine of up to $10,000.
  • Class A Felony: up to 50 years in prison and a fine of up to $10,000.

According to the Drug Enforcement Administration DEA), drug schedules are as follows:

  • Schedule I Drugs – GHB, Cannabis, Heroin, Ecstasy, Psychedelic Mushrooms, Foxy, LSD, Peyote, Mescaline, Quaalude, STP, THG, Blue Mystic, Nexus, Ketoamphetamine, etc.
  • Schedule II Drugs – Cocaine, Methamphetamine, Ritalin, Opium, Methadone, Percocet, OxyContin, Percodan, Morphine, PCP, Amphetamines, Demerol, Nembutal, etc.
  • Schedule III Drugs - Anabolic Steroids, Ketamine, Marinol, Xyrem, Vicodin, Tylenol 3, Codeine, LSA, Pentobarbital, Talbutal, Hydrocodone, Oxymorphone, Dihydrocodeine, Dilaudid, etc.

The charge for marijuana or cannabis products is different than the rest of the Schedule I drugs. Possession or cultivation of less than 30 grams of marijuana or possession of less than two grams of either hash oil or hashish is a Class A misdemeanor. If the amount in possession is more than the above mentioned quantities or if the person has a prior conviction for a similar charge, the charge is then a Class D felony.

Possession of paraphernalia is also illegal. In Indiana, any person who possesses the raw material, instrument, device, or other object intended for the purpose of introducing a controlled substance into the body commits a Class A infraction. That includes devices for enhancing the effects or testing the strength, effectiveness, or purity of a controlled substance.
